Terms and Conditions

These Terms and Conditions (“Terms”) govern your access to and use of Dink Tank Pickleball, LLC programming and/or properties (“Facility,” “we,” “us,” or “our”), including participation in pickleball and other group activities, use of courts and amenities, and the purchase of food, beverages, merchandise, and services. By entering activities and/or the Facility, making a purchase, or participating in any activity, you agree to be bound by these Terms.

1. Eligibility & Access

• Guests must comply with all posted rules, policies, and staff instructions.
• We reserve the right to refuse entry or remove any individual for unsafe, disruptive, or inappropriate behavior.
• Minors must be supervised by a parent or legal guardian at all times unless participating in an approved program.
  

2. Assumption of Risk 

Pickleball and related activities involve inherent risks, including but not limited to physical injury, collisions, slips, falls, and equipment-related injuries.

By participating in any activity or entering the Facility, you voluntarily assume all risks, whether known or unknown, associated with pickleball, fitness activities, and Facility use.

3. Waiver and Release of Liability

To the fullest extent permitted by law, you agree to release, waive, and hold harmless Dink Tank Pickleball, LLC, its owners, employees, contractors, and affiliates from any claims, injuries, damages, losses, or liabilities arising from:

• Participation in pickleball or other activities.
• Use of courts, equipment, or facilities.
• Consumption of food or beverages.
• Acts of other participants or guests.

This release applies except in cases of gross negligence or willful misconduct where prohibited by law.

4. Health & Fitness Disclaimer

You acknowledge that:

• You are physically capable of participating in activities at the Facility.
• You are responsible for consulting a medical professional regarding participation.
• The Facility does not provide medical advice or supervision.
   

5. Food & Beverage Sales

• All food and beverage sales are final unless otherwise required by law.
• The Facility is not responsible for allergic reactions; ingredient information may be available upon request.
• Alcoholic beverages (if applicable) are sold only to individuals of legal drinking age with valid identification.
• We reserve the right to refuse alcohol service to any guest.
   

6. Merchandise Sales

• Merchandise may include apparel, paddles, accessories, and branded items.
• Returns or exchanges are subject to our posted return policy.
• All merchandise is sold “as is” unless otherwise stated.
   

7. Services, Lessons & Reservations

• Services may include court rentals, lessons, clinics, leagues, events, and memberships.
• Reservations, cancellations, and refunds are subject to Facility policies posted at the time of booking.
• Missed appointments or no-shows may be charged in full.
   

8. Facility Rules & Conduct

Guests must:

• Use equipment and amenities properly and for its intended purpose.
• Wear appropriate athletic attire and footwear with non-marking soles.
• Refrain from abusive, unsafe, or illegal behavior.
• Respect staff and other guests.
   

Failure to comply may result in removal without refund.

9. Personal Property

The Facility is not responsible for lost, stolen, or damaged personal items. Lockers, if available, are used at your own risk.

10. Photography & Media Release

By entering the activities and/or Facility, you grant permission for the use of your likeness in photographs or videos taken on the premises for promotional, marketing, or social media purposes, unless you notify us in writing.

11. Intellectual Property

All logos, branding, content, and materials associated with Dink Tank Pickleball, LLC  and/or Facility are owned by or licensed to Dink Tank Pickleball, LLC and may not be used without written permission.

12. Termination of Access

We reserve the right to suspend or terminate access, memberships, benefits, or services at our discretion for violations of these Terms or Facility policies.

13. Indemnification

You agree to indemnify and hold harmless the Facility from any claims or damages resulting from your actions, violations of these Terms, or misuse of the Facility.

14. Governing Law

These Terms are governed by the laws of the State of North Carolina, without regard to conflict of law principles.

15. Modifications

We may update these Terms at any time. Continued use of the Facility after changes constitutes acceptance of the revised Terms.

ALCOHOL SERVICE & CONSUMPTION POLICY

1. Legal Compliance

Dink Tank Pickleball, LLC complies with all applicable federal, state, and local laws governing the sale and service of alcoholic beverages. Alcoholic beverages are sold and served only in accordance with applicable alcohol beverage control regulations.

2. Age Verification

• Alcoholic beverages are sold only to individuals twenty-one (21) years of age or older, or the legal drinking age in the applicable jurisdiction.
• Valid government-issued photo identification is required and must be presented upon request.
• The Facility reserves the right to refuse alcohol service to any individual who fails to present valid identification, presents false identification, or appears underage.
   

3. Responsible Service & Right to Refuse

The Facility reserves the absolute right, at its sole discretion, to:

• Refuse or discontinue alcohol service to any guest who appears intoxicated.
• Refuse service to any guest whose behavior is unsafe, disruptive, or inappropriate.
• Limit the quantity of alcohol served to any individual.
   

Guests acknowledge that alcohol service is a privilege, not a right.

4. Consumption Restrictions

• Alcoholic beverages must be consumed only within designated areas of the Facility.
• Alcohol may not be brought into or removed from the Facility unless expressly permitted by law.
• Sharing, reselling, or providing alcohol to minors or intoxicated individuals is strictly prohibited. 

5. Assumption of Risk & Alcohol Consumption

Guests voluntarily assume all risks associated with alcohol consumption, including but not limited to impaired judgment, coordination, or physical ability.

Guests acknowledge that participation in pickleball or other physical activities while consuming alcohol increases the risk of injury, and they assume full responsibility for their decision to engage in such activities.

6. Limitation of Liability

To the fullest extent permitted by law, Dink Tank Pickleball, LLC shall not be liable for any injuries, damages, losses, or claims arising from:

• A guest’s consumption of alcohol.
• A guest’s decision to participate in physical activities after consuming alcohol.
• The actions of any intoxicated guest.
   

7. Transportation & Safety

Guests are solely responsible for arranging safe transportation after consuming alcohol. The Facility strongly encourages responsible consumption and the use of designated drivers or rideshare services.

8. Violations

Any violation of this Alcohol Service & Consumption Policy may result in:

• Immediate cessation of alcohol service.
• Removal from the Facility without refund.
• Suspension or termination of membership or access.
• Notification of law enforcement where required by law.
